Abstract

The Trademarks Act, 1999, is a vital legal framework in India for enforcing intellectual property rights. Trademarks serve as key identifiers, distinguishing the goods and services of one entity from another while representing quality, trust, and brand reputation. This Act ensures the protection of trademark owners' rights and maintains marketplace integrity by combating infringement and counterfeiting. Criminal penalty proceedings under this Act play a crucial role in addressing violations, with the standard of proof—guilt established beyond a reasonable doubt—being central to these cases. Such proceedings prosecute individuals or entities involved in offenses like trademark infringement or counterfeiting.  Post the changes brought about by the Jan Vishwas Act 2023 to the Trademarks Act 1999, wherein the criminal provisions have been reduced and civil remedies have been strengthened, to streamline the dispute resolution process. In spite of these changes the notion of guilt established beyond a reasonable doubt remains to establish the act of violation under the Act. This paper provides a 360-degree examination of criminal trademark enforcement in India, analyzing the statutory framework under the Trademarks Act, 1999, seminal case laws including Parle Products v. JP & Co., and comparative implementation of TRIPS Article 61 across jurisdictions. It evaluates the impact of the Jan Vishwas Act, 2023 reforms while suggesting actionable improvements for India's IP enforcement regime.
